Terms and Conditions for Express Print South Africa
EXPRESS PRINT TERMS & CONDITIONS
Effective Date: 15 January2025 | Governing Law: Republic of South Africa
1. DEFINITIONS
“Business Day” means 08:00-17:00 SAST weekdays excluding public holidays. “Approved Artwork” means client-provided files meeting §3 specifications.
2. BINDING AGREEMENT
These written Terms supersede all verbal representations by Express Print staff (CPA Section 22). Electronic acceptance constitutes binding agreement (ECTA Section 13).
3. ORDER REQUIREMENTS
2.1 Payment must clear before production commences.
2.2 Same-day orders:

Deadline: 09:00 SAST

Requires: Approved Artwork + cleared payment
4. ARTWORK SPECIFICATIONS
3.1 Client bears sole responsibility for:

Print-ready files (300dpi, 3mm bleed)
-
Embedded Pantone® (PMS) colours
3.2 Errors causing reprints incur additional fees.
5. PRODUCTION TIMEFRAMES
4.1 Minimum 8 Business Hours required for all orders.
4.2 Same-day delivery voided automatically if §2-3 not satisfied.
6. DELAY LIABILITY EXCLUSIONS
Express Print is not liable for delays caused by:

Eskom load-shedding/power failures
-
Late material deliveries from suppliers
-
Client errors (§3) or payment delays
7. DELIVERY TIMELINES
6.1 Pre-payment delivery estimates extend automatically to cover:

Artwork revisions
-
Payment clearance delays
-
Client information errors
8. NO REFUNDS POLICY
All sales final (CPA Section 54(2)(c)). No refunds for:

Completed orders
-
Colour variations vs. approved proofs
-
Negative/defamatory reviews (§18)
-
Delays under §6
9. MATERIAL DEFECTS EXCEPTION
Refunds only considered for undisputed physical defects (CPA Section 56), provided:

Reported within 48 hours of delivery

Goods returned unused
10. RISK TRANSFER
Ownership and risk pass to client upon dispatch (CPA Section 19).
11. REVIEW POLICY
11.1 Genuine feedback is welcomed.
11.2 No refunds issued for negative reviews.
11.3 Defamatory reviews (false statements causing reputational harm) may result in:

Legal action under Common Law

Claims for damages + legal costs
12. CLIENT INDEMNITY
You indemnify us against losses from:

Artwork copyright violations
-
False/misleading reviews (§11.3)

Delivery address errors
13. LIABILITY CAP
Maximum liability = order value paid (CPA Section 61(1)). Excludes indirect/consequential losses.
14. FORCE MAJEURE
Not liable for failures due to:

National strikes
-
Government actions
-
Acts of God
15. TERMINATION
We may cancel orders if:

Payment not cleared within 24h
-
Artwork remains non-compliant after 2 requests
16. GOVERNING LAW
Disputes subject to exclusive jurisdiction of South African courts.
17. NOTICES
Legal notices valid via email to account-registered address (ECTA Section 11).
18. SEVERABILITY
If any clause is unenforceable, remainder survives fully valid.
19. AMENDMENTS
Terms updated periodically; continued use = acceptance. Archived versions at [URL].
20. ENTIRE AGREEMENT
Constitutes the complete understanding between parties (CPA Section 22).
